The City of Lockhart Planning and Zoning Commission will hold a Public Hearing on Wednesday, April 22, 2015, at 7:00 P.M. in the lower level of City Hall, 308 West San Antonio Street, Lockhart, Texas, to receive public input regarding the following:

SUP-15-04. A request by Lockhart I.S.D. for a Specific Use Permit to allow a net increase of approximately 30,000 square feet floor area for the proposed demolition, renovation, and new construction activity at Lockhart High School on approximately 36 acres in the Francis Berry Survey, Abstract #2, zoned PI Public and Institutional District and located at 906 Center Street.

These notices shall satisfy two separate but related, procedural requirements for activities to be undertaken by the City of Martindale.

 

REQUEST FOR

RELEASE OF FUNDS

On or about 5/4/15, the City of Martindale will submit a request to the Texas Department of Agriculture, Office of Rural Affairs for the release of Community Development Block Grant funds under Section 104(f) of Title I of the Housing and Community Development Act of 1974, as amended, to undertake a project known as 2014 CDBG City of Martindale Sewer Improvements Project #7214291, for the purpose of installing first-time sewer service to the project area, to negate the problems of leakage and contamination caused by old and deteriorating septic tanks. Contractor shall install approximately 1,935 LF of 8” sewer line, approximately 125 LF of bore, 6 manholes, pavement and driveway repair, and all associated appurtenances. Contractor shall provide first-time sewer service to 18 households. Contractor shall install 18 sewer yard lines, mitigate all existing septic systems, and all associated appurtenances. TxCDBG funds shall not fund a yard service line on private property to a household that does not qualify as low- to-moderate income. Residents will be served by the Martindale WSC. The project locations are Skyline Drive from end to end, Skyview Drive from Skyline Drive to Highway 80, Highway 80 from Skyview Drive northwest to easement, and easement from Highway 80 to CR 103. An alternate route that is being considered is from Skyline Drive to NW River Road. The grant amount is $275,000.00.

FINDING OF NO

SIGNIFICANT IMPACT

The City of Martindale has determined that the project will have no significant impact on the human environment; therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the City of Martindale, 409 Main Street, Martindale, TX 78655, and may be examined or copied Monday through Friday 9:00 A.M. to 4:00 P.M.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the City of Martindale Mayor’s office. All comments received by 5/1/15 will be considered by the City of Martindale prior to authorizing submission of a Request for Release of Funds. Comments should specify which Notice they are addressing.

ENVIRONMENTAL CERTIFICATION

The City of Martindale certifies to the Texas Department of Agriculture, Office of Rural Affairs that Doyle Mosier, in his capacity as Mayor, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Department’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City of Martindale to use Program funds.

OBJECTIONS TO

RELEASE OF FUNDS

The Texas Department of Agriculture will accept objections to its release of funds and the City of Martindale’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request, (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Martindale; (b) the City of Martindale has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the Department; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the Texas Department of Agriculture Office of Rural Affairs at P.O. Box 12847, Austin, Texas 78711. Potential objectors should contact the Department to verify the actual last day of the objection period.
