NOTICE OF

REQUIREMENT TO COMPLY WITH THE SUBDIVISION AND SERVICE EXTENSION POLICY OF    

POLONIA WATER

SUPPLY

CORPORATION

 

Pursuant to Chapter 13.2502 of the Texas Water Code, Polonia Water Supply Corporation hereby gives notice that any person who subdivides land by

dividing any lot, tract, or parcel of land, within the service area of Polonia Water Supply Corporation, Certificate of Convenience and Necessity No. 10420, in Caldwell County, into two or more lots or sites for the purpose of sale or development, whether immediate or future, including re-subdivision of land for which a plat has been filed and recorded or requests more than two water service connections on a single contiguous tract of land must comply with Section F. Developer, Subdivision, and Non-Standard Service Requirements contained in Polonia Water Supply Corporation”s tariff.

 

Polonia Water Supply Corporation is not required to extend retail water utility service to a service applicant in a subdivision where the developer of the subdivision has failed to comply with the Subdivision Policy.

 

Among other requirements, the Subdivision Policy requires:

 

Applicable elements of the Subdivision Policy, depending on the specific circumstances of the subdivision service, may include:

 

Evaluation by Polonia Water Supply Corporation of the impact a proposed subdivision service extension will make on Polonia Water Supply Corporation”s water supply and payment of the costs for this evaluation;

 

Payment of fees for reserving water supply;

 

Forfeiture of reserved water supply capacity for failure to pay applicable fees;

 

Payment of costs of any improvements to Polonia Water Supply Corporation”s system that are necessary to provide the water/sewer service;

 

Construction according to design approved by

Polonia Water Supply Corporation and dedication by the developer of water facilities within the subdivision following inspection.

 

Polonia Water Supply Corporation”s tariff and a map showing Polonia Water Supply Corporation”s service area may be reviewed at Polonia Water Supply Corporation”s offices, at 2990 FM 1185, Lockhart, Texas, the tariff/policy and service area map also are filed of record at the Texas Commission for Environmental Quality in Austin, Texas and may be reviewed by contacting the TCEQ, c/o Utility Rates and Services Section, Water Utilities Division, P.O. Box 13087, Austin, Texas 78711-3087.

NOTICE OF PUBLIC HEARING

 

The City of Lockhart Planning and Zoning Commission will hold a Public Hearing on Wednesday, December 9, 2015, at 7:00 P.M. in the lower level of City Hall, 308 West San Antonio Street, Lockhart, Texas, to receive public input regarding the following:

 

SUP-15-12. A request by Mike Mann on behalf of Jeff Gibeaux for a Specific Use Permit to allow a Mixed Use Building, Bar, and Food Processing and Preparation Plant on Part of Lot 1, Block 23, Original Town of Lockhart, consisting of approximately 0.065 acre zoned CCB Commercial Central Business District and located at 101 East San Antonio Street.

All interested persons owning property within 200 feet of this property who wish to state their support or opposition may do so at this Public Hearing; or they may submit a written statement to the City Planner or his designee for presentation to the Planning and Zoning Commission at or before the time the Public Hearing begins.

 

Should any person be aggrieved by the Commission’s action, a request may be submitted in writing for an appeal to City Council. Such request must be submitted to the Zoning Administrator (City Planner) within ten calendar days of the date of the Commission’s action.

NOTICE OF PUBLIC HEARING

 

The City of Lockhart Planning and Zoning Commission will hold a Public Hearing on Wednesday, December 9, 2015, at 7:00 P.M. in the lower level of City Hall, 308 West San Antonio Street, Lockhart, Texas, to receive public input regarding the following:

 

ZC-15-06. A request by Jeremy McCord, for a Zoning Change from RMD Residential Medium Density District to CMB Commercial Medium Business District on Lot 6, Block 1, South Addition, located at 1100 South Commerce Street.

 

ZC-15-07. A request by Ramasamy Kulanthaivelu for a Zoning Change from CLB Commercial Light Business District to CMB Commercial Medium Business District for 0.527 acres in the Byrd Lockhart Survey, Abstract No. 17, located at 730 South Colorado Street (HWY 183).

 

All interested persons owning property within 200 feet of these properties wishing to state their support or opposition may do so at this Public Hearing; or they may submit a written statement to the City Planner or his designee for presentation to the Planning and Zoning Commission at or before the time the Public Hearing begins.

 

In the event that property owners should desire to protest the action of the Planning and Zoning Commission, they must: (1) file their written protest with the City Secretary on or before five days prior to the Public Hearing before the City Council; and, (2) the written protest must be signed and acknowledged by the owners of at least 20 percent of the land included in the proposed change, or by owners of at least 20 percent of the land area within a 200-foot radius of the boundary of the proposed change. To be a valid protest, both conditions (1) and (2) above must be met or the petition will be rejected.

 

The City of Lockhart City Council will hold a Public Hearing on Tuesday, December 15, 2015, 7:30 PM in the City Council Chamber, 3rd floor of the Clark Library-Masonic Building, 217 South Main Street, Lockhart, Texas, to consider these zoning change requests, the recommendation of the Planning and Zoning Commission, and valid protests if any.
