Attempted murder suspect has history with cops

A Caldwell County man remains in custody this week and investigators are still seeking answers after a three-hour standoff in rural Caldwell County last week.

Gilbert Montoya, 78, was arrested and charged with Deadly Conduct and Attempted Capital Murder on Feb. 7, 2013, after Sheriff’s deputies received a

complaint of “shots fired” near his home on Old Kelley Road. A deputy responded to the call to investigate, and as he left the premises, Montoya allegedly fired several rounds at his patrol car with an unknown caliber and make of weapon.

Although rounds struck the unit, the deputy was able to leave the scene uninjured.

Law enforcement established a command post, and enlisted the help of Hays County SWAT, the Department of Public Safety, and the Austin Police Department’s AirOne and K-9 teams, as well as local police officers from Lockhart and Luling, and from Caldwell County Constable Precinct 4.

First responders from the McMahan area were also on hand to treat any injuries, though no injuries were reported.

After the standoff, which included heavy police presence and a helicopter search of the property, Montoya was taken into custody and transported to the Caldwell County Jail. His bond was set by Judge Matt Kiely, in the amount of $200,000 for Deadly Conduct, and for $1 million for Attempted Capital Murder.

It remains unclear what Montoya was shooting at to initiate the call, but a search of records indicates that deputies have responded to Montoya’s residence before for “shots fired” calls. No further information was released by the Caldwell County Sheriff’s Department as to Montoya’s criminal or mental health history.

Montoya remains in custody in the Caldwell County Jail, and law enforcement continues to investigate the incident.

    This was a totally ridiculous waste of taxpayers money and resources to have this amount of police force to round up an old 78 man.

    Well when the 78 old man has more guns than the cops at the scene have, kinda need to call in the big boys, he should count himself lucky because not many people shoot at a cop and live to go to jail

    Heard but can not verify his past military experience and whether or not it has anything to do with his behavior. Has anyone researched his military past and see if he needs help medical help.
