NOTICE OF REQUIREMENT TO COMPLY WITH THE

SUBDIVISION SERVICE

EXTENSION POLICY OF COUNTY LINE SPECIAL UTILITY DISTRICT

 

Pursuant to chapter 13.2502 of

the Texas Water Code, County

Line Special Utility District

hereby gives notice that any person who subdivides land by dividing any lot, tract, or parcel of land, within the service area of County Line Special Utility District,  Certificate of Convenience and Necessity No. 10292, in Hays and Caldwell County, into two or more lots or sites for the purpose of sale or development, whether immediate or future, including re-subdivision of land for which a plat has been filed and recorded or requests more than two water service connections on a single contiguous tract of land must comply with the service extension policy stated in the district service policy contained in County Line Special Utility District’s district service policy.

County Line Special Utility District is not required to extend retail water utility service to a service applicant in a subdivision where the developer of the subdivision has failed to comply with the Subdivision Policy.

 

Applicable elements of the Subdivision Policy, depending on the specific circumstances of the subdivision service, may include:

• Evaluation by County Line Special Utility District of the impact a proposed subdivision service extension will make on County Line Special Utility Districts water supply service system and payment of the costs for this evaluation;

• Payment of reasonable costs or fees by the developer for providing water service capacity;

• Payment of fees for reserving water service capacity;

• Forfeiture of reserved water supply service capacity for failure to pay applicable fees;

• Payment of costs of any improvements to County Line Special Utility Districts system that are necessary to provide the water service:

• Construction according to design approved by County Line Special Utility District and dedication by the developer of water facilities within the subdivision following inspection.

 

County Line Special Utility District’s district service policy and a map showing County Line Special Utility District’s service area may be reviewed at County Line Special Utility District’s offices at 131 S. Camino Real, Uhland, TX 78640, the district service policy and service area map are filed of record at the Texas Commission on Environmental Quality in Austin, Texas and may be reviewed by contacting the TCEQ, c/o Utility Rates and Services Section, Water Utilities Division, P.O. NOTICE OF

PUBLIC HEARING

The City of Lockhart Planning and Zoning Commission will hold a Public Hearing on Wednesday, June 27, 2012, at 7:00 P.M. in the lower level of City Hall, 308 West San Antonio Street, Lockhart, Texas, to receive public input regarding the following:

 

ZC-12-03.  A request by J. D. Remley for a Zoning Change from AO Agriculture-Open Space District to PDD Planned Development District on 56.691 acres in the Frances Berry Survey, Abstract No. 2, located along the west side of the 700-1000 blocks of City Line Road.  The PDD zoning is accompanied by a PDD Development Plan that shows the proposed land uses and other features of the site.  The PDD Development Plan may be viewed in the Planning Department office.

 

All interested persons owning property within 200 feet of this property wishing to state their support or opposition may do so at this Public Hearing; or they may submit a written statement to the City Planner or his designee for presentation to the Planning and Zoning Commission at or before the time the Public Hearing begins.

 

In the event that property owners should desire to protest the proposed zoning change, they must: (1) file their written protest with the City Secretary on or before five days prior to the Public Hearing before the City Council; and, (2) the written protest must be signed and acknowledged by the owners of at least 20 percent of the land included in the proposed change, or by owners of at least 20 percent of the land area within a 200-foot radius of the boundary of the proposed change.  To be a valid protest, both conditions (1) and (2) above must be met or the petition will be rejected.

 

The City of Lockhart City Council will hold a Public Hearing on Tuesday, July 3, 2012, at 7:30 PM in the lower level of City Hall, 308 W. San Antonio, Lockhart, Texas, to consider this zoning change request, the recommendation of the Planning and Zoning Commission, and valid protests if any.

AN ORDINANCE OF THE CITY OF LOCKHART, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LOCKHART, TEXAS, TO RECLASSIFY THE PROPERTY KNOWN AS ONE ACRE IN THE MILES G. DIKES _ LEAGUE, ABSTRACT NO. 6, LOCATED AT 2501 NORTH COLORADO STREET (US 183), FROM AO AGRICULTURE-OPEN SPACE DISTRICT TO CMB COMMERCIAL MEDIUM BUSINESS DISTRICT.

 

ORDINANCE 2012-12

AN ORDINANCE OF THE CITY OF LOCKHART, TEXAS: A) AMENDING CHAPTER 26 “HEALTH AND SANITATION”, ARTICLE II “FOOD AND FOOD HANDLERS”, OF THE LOCKHART CODE OF ORDINANCES, DELETING THE TEXT OF SECTION 26-75 “PORTABLE FOOD SERVICE FACILITIES” AND RESERVING THE SECTION FOR FUTURE USE; AND, B) AMENDING CHAPTER 64 “ZONING”, RENAMING ARTICLE VII “ZONING DISTRICTS” TO “ZONING DISTRICTS AND STANDARDS”, RESERVING A NEW SECTION 64-204, ADDING A NEW SECTION 64-205 “PORTABLE FOOD ESTABLISHMENTS”, RESERVING NEW SECTIONS 64-206 THROUGH 64-209, AND ADDING A NEW SECTION 64-210 “PENALTY FOR VIOLATION”; PROVIDING FOR SEVERABILITY; PROVIDING A REPEALER; PROVIDING FOR PENALTY; PROVIDING FOR PUBLICATION; AND ESTABLISHING AN EFFECTIVE DATE.

 

PENALTY:  ANY PERSON THAT VIOLATES THIS ORDINANCE SHALL BE GUILTY OF A MISDEMEANOR, AND UPON CONVICTION SHALL BE FINED AS PROVIDED IN SECTION 1-8 OF THE CITY CODE.
