REQUEST FOR

RELEASE OF FUNDS

On or about 5/6/14, the City of Uhland will submit a request to the Texas Department of Agriculture (TDA) Office of Rural Affairs for the release of 2013-14 Community Development Funds under Section 104(f) of Title 1 of the Housing and Community Development Act of 1974 as amended, to undertake the following project:

 

Project Title: City of Uhland Water Improvements Project #713470

Purpose:  To provide the City of Uhland adequate service by replacing existing water line that is too small with appropriately sized water line.

 

Project Description:The City, in conjunction with County Line Special Utility District, shall provide an adequately sized water loop to serve Uhland.  This will ensure the citizens of a constant, adequate, potable water service at adequate pressures and flow rates.  Construction shall consist of the installation of twelve thousand four hundred linear feet (12,400 LF) of eight-inch (8”) PVC water line with one hundred sixty linear feet (160 LF) of bore, twelve (12) fire hydrants and associated appurtenances.

FINDING OF NO

SIGNIFICANT IMPACT

The City of Uhland has determined that the project will have no significant impact on the human environment; therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.  Additional project information is contained in the Environmental Review Record (ERR) on file at The City of Uhland, 15 N. Old Spanish Trail, Uhland, TX 78640 and may be examined or copied weekdays 9 A.M. to 4 P.M.

 

FINAL NOTICE AND PUBLIC EXPLANATION OF PROPOSED

ACTIVITY IN A 100-YEAR FLOODPLAIN

This is to give notice that the City of Uhland has conducted an evaluation as required by Executive Order 11988, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management, to determine the potential affect that its activity in the floodplain will have on the human environment for the City of Uhland Water Improvements Project #713470, funded under the Texas Community Development Program in the total grant amount of $275,000.

 

The City of Uhland has reevaluated the alternatives to building in the floodplain and has determined that there is no practicable alternative.  Environmental files that document compliance with steps 3 through 6 of Executive Order 11988 are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments.  This activity will have no significant impact on the environment because the proposed improvements will occur at their current locations, of which a portion is already geographically located in the floodplain.  Proposed improvements will prevent frequent maintenance issues and disruptions in service.

 

There are three primary purposes for this notice.  First, people who may be affected by activities in floodplains, and those who have an interest in the protection of the natural environment, should be given an opportunity to express their concerns and provide information about these areas.  Second, an adequate public notice program can be an important public educational tool. The dissemination of information about floodplains can facilitate and enhance Federal efforts to reduce the risks associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains, it must inform those who may be put at greater or continued risk.

 

PUBLIC COMMENTS

Any individual, group or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the City of Uhland.  All comments received by 5/3/14 will be considered by the City of Uhland prior to authorizing submission of a Request for Release of Funds.  Commenters should specify which part of this Notice they are addressing.  Comments must be submitted to: Mayor Glenn Smith, City of Uhland, 15 N. Old Spanish Trail, Uhland, TX 78640 between the hours of 8:00 AM to 5:00 PM.

 

RELEASE OF FUNDS

The City of Uhland certifies to the Texas Department of Agriculture that Glenn Smith, in his capacity as Mayor, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  The TDA’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City of Uhland to use Program funds.

 

OBJECTIONS TO

RELEASE OF FUNDS

The TDA will consider objections to its release of funds and the City of Uhland certification received by 5/21/14 or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer or other officer of the City of Uhland approved by the TDA; (b) the City of Uhland has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the TDA; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to the Texas Department of Agriculture at P.O. Box 12847, Austin, TX 78711.  Potential objectors should contact the TDA to verify the actual last day of the objection period.

NOTICE OF SALE OF REAL PROPERTY

The Board of Trustees of the Lockhart Independent School District (“LISD”) hereby serves notice that it will accept sealed bids for the following real property:

The surface only (mineral estate reserved) described as: approximately .81 acres of real property located at or near the intersection of Highway 21 and FM 1854, and described as : 1 acre out of the Pablo Martinez League, being out of and a part of the tract of 147.7 acres of land conveyed to Edgar Smith by C. M. Dugger and wife by deed dated May 10, 1913, and recorded in Volume 50, Page 548 of the Caldwell County, Texas deed records as described in a deed dated March 24, 1932, recorded in Volume 157, Page 177, of the Caldwell County deed records, and less the .19 acres as described in a deed dated March 6, 1956, from the Lockhart Independent School District to the State of Texas, and recorded in Volume 266, Page 258, of the Deed Records of Caldwell County, Texas.

The Property will be conveyed subject to the exceptions and reservations contained in the Bid Package, including the reservation and exception that this is a conveyance of the surface only. ADVERTISEMENT FOR BIDDERS

Notice is hereby given that Caldwell County ESD #2 will receive sealed bids via hard copy or email in the Office of Gallup Engineering located at 2019 Clovis Barker Road, Suite A-105, San Marcos, Texas 78666 (anne@gallupengineering.com), up to May 5th at 12:00 pm, for furnishing all labor and materials and performing all work necessary for the construction of a new 2,480 s.f. metal building and concrete foundation and additional concrete slabs (3,270 s.f.) to be located at the Maxwell Community Fire Department at 9655 Highway 142 in Maxwell, Texas. Bids must be received by May 5th at 12:00 pm and will be opened at 3 pm May 5th at Gallup Engineering, 2019 Clovis Barker Road, San Marcos, Texas. Bid will be awarded on May 8th at the regular meeting of the board of Caldwell County ESD #2 at 7 pm 9655 Highway 142, Maxwell, Texas.

Bidders may bid on entire work description or parts of the work description. Bids will be submitted using lump sum pricing. Payment for the work will be issued upon percentage or completion of the work. Work is to be completed 120 days after bid contract acceptance.

The bonds required will be a Performance Bond, each in the full amount of the contract. Caldwell County ESD #2 will not accept letter of credit in lieu of any bond required herein.
