ORDINANCE 2016-09

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LOCKHART, TEXAS, AMENDING CHAPTER 36 OF THE CODE OF ORDINANCE, ENTITLED “OFFENSES AND MISCELLANEOUS PROVISIONS”, PROVIDING A MORE COMPREHENSIVE CURFEW FOR MINORS; PROVIDING FOR PARENT RESPONSIBILITY; PROVIDING FOR ENFORCEMENT; PROVIDING PENALTY FOR VIOLATIONS; PROVIDING FOR SEVERABILITY; PROVIDING A REPEALER; PROVIDING FOR PUBLICATION; AND ESTABLISHING AN EFFECTIVE DATE.

 

PENALTY: (a) A person who violates a provision of this ordinance is guilty of a misdemeanor. Each day or part of a day during which the violation is committed, continued, or permitted is a separate offense. Each offense, upon conviction, is punishable by a fine not to exceed $500.00 pursuant to Sec. 1-8 of the Lockhart Code of Ordinances.

(b) When required by V.T.C.A., Texas Family Code § 51.08, as amended, the Lockhart Municipal Court shall waive original jurisdiction over a minor who violates Sec. 36-12(a) of this article and shall refer the minor to juvenile court.

 

ORDINANCE 2016-10

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LOCKHART, TEXAS AMENDING CHAPTER 18, ARTICLE III., CAPTIONED “NUISANCES”, OF THE LOCKHART CODE OF ORDINANCES, ADDING A DIVISION ENTITLED “RESIDENTIAL OUTDOOR STORAGE”; PROHIBITING THE STORAGE OF UNSCREENED ITEMS AND MATERIAL IN RESIDENTIAL DISTRICTS WITHIN THE CITY; PROVIDING FOR PENALTY; PROVIDING A REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR PUBLICATION; AND ESTABLISHING AN EFFECTIVE DATE.

 

PENALTY: (a) Whenever a violation of this division is found to exist on a residential property, the owner and/or occupant of such premises shall be notified by the city, in writing, to correct, remedy or remove the condition within ten (10) days after such notice, and it shall be unlawful for any person to fail to comply with such notice.

 

(b) Notice to the owner and/or occupant of the premises shall comply with V.T.C.A., Health and Safety Code, Sec. 342.006, as amended from time to time.

 

ORDINANCE 2016-11

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LOCKHART, TEXAS, AMENDING CHAPTER 10 OF THE LOCKHART CODE OF ORDINANCES, CAPTIONED “ANIMALS AND BEEKEEPING”, TO PROVIDE FOR RESTRICTIONS ON TYPE, SIZE AND LOCATIONS FOR KEEPING CERTAIN LIVESTOCK AND FOWL; PROVIDING FOR PENALTY; PROVIDING FOR SEVERABILITY; PROVIDING A REPEALER; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE.

 

PENALTY: Any person who violates a provision of Chapter 10 of the Lockhart Code of Ordinances is deemed guilty of a misdemeanor and is subject to penalty as provided in Sec. 10-15, and upon conviction, including fine in the sum of not less than $50.00 nor more than $250.00, and each and every day’s violation shall constitute a separate and distinct offense. Subsequent convictions for any violation of Chapter 10 within a 12-month period shall be fined an amount not more than $500.00, and each day’s violation shall constitute a separate and distinct offense.

NOTICE OF PUBLIC HEARING

The City of Lockhart Planning and Zoning Commission will hold a Public Hearing on Wednesday, April 27, 2016, at 7:00 P.M. in the lower level of City Hall, 308 West San Antonio Street, Lockhart, Texas, to receive public input regarding the following:

SUP-16-05. A request by Jesus & Christina Onofre for a Specific Use Permit to allow a Manufactured Home on Lots 4 and 5, Block D, Oakview Annex Addition, zoned RMD Residential Medium Density District and located at 1007 Pancho Street.

All interested persons owning property within 200 feet of this property who wish to state their support or opposition may do so at this Public Hearing; or they may submit a written statement to the City Planner or his designee for presentation to the Planning and Zoning Commission at or before the time the Public Hearing begins.

 

Should any person be aggrieved by the Commission’s action, a request may be submitted in writing for an appeal to City Council. Such request must be submitted to the Zoning Administrator (City Planner) within ten calendar days of the date of the Commission’s action.

The City of Lockhart Planning and Zoning Commission will hold a Public Hearing on Wednesday, April 27, 2016, at 7:00 P.M. in the lower level of City Hall, 308 West San Antonio Street, Lockhart, Texas, to receive public input regarding the following:

 

ZC-16-02. A request by Magesh Gurunath, on behalf of OM Holdings, LLC, for a Zoning Change from RMD Residential Medium Density District to CMB Commercial Medium Business District for 0.492 acres in the Byrd Lockhart League, Abstract No. 17, part of Lot 1, Block 48, Original Town of Lockhart located at 601 West San Antonio Street (HWY 142).

 

All interested persons owning property within 200 feet of this property wishing to state their support or opposition may do so at this Public Hearing; or they may submit a written statement to the City Planner or his designee for presentation to the Planning and Zoning Commission at or before the time the Public Hearing begins.

 

In the event that property owners should desire to protest the action of the Planning and Zoning Commission, they must: (1) file their written protest with the City Secretary on or before five days prior to the Public Hearing before the City Council; and, (2) the written protest must be signed and acknowledged by the owners of at least 20 percent of the land included in the proposed change, or by owners of at least 20 percent of the land area within a 200-foot radius of the boundary of the proposed change. To be a valid protest, both conditions (1) and (2) above must be met or the petition will be rejected.

 

The City of Lockhart City Council will hold a Public Hearing on Tuesday, May 3, 2016, 7:30 PM in the City Council Chamber, 3rd floor of the Clark Library-Masonic Building, 217 South Main Street, Lockhart, Texas, to consider this zoning change request, the recommendation of the Planning and Zoning Commission, and valid protests if any.
