ORDINANCE 2015-26
AN ORDINANCE OF CITY COUNCIL OF THE CITY OF LOCKHART, TEXAS AMENDING THE LOCKHART CODE OF ORDINANCES, CHAPTER 58, “UTILITIES”, ARTICLE III, “WATER, SEWER, ELECTRIC EXTENSIONS”, TO ADD DIVISION 2, “DISTRIBUTED GENERATION”; ESTABLISHING THE REQUIREMENTS FOR INTERCONNEC
TION AND PARALLEL OPERATION OF DISTRIBUTED GENERATION FACILITIES WITHIN THE CITY OF LOCKHART ELECTRIC SYSTEM; PROHIBITING INTERCONNECTION AND/OR PARALLEL OPERATION OF DISTRIBUTED GENERATION WITHOUT COMPLIANCE WITH THIS ORDINANCE; PROVIDING FOR SEVERABILITY; PROVIDING A REPEALER; PROVIDING PENALTY; PROVIDING FOR PUBLICATION; AND ESTABLISHING AN EFFECTIVE DATE.
Penalty: Any person violating this Ordinance by interconnecting distributed generation to the Lockhart electric system without a completed Application and executed Agreement as required in this Ordinance shall, upon conviction, be guilty of a misdemeanor and shall be fined not less than $1.00 nor exceeding $2,000.00 per violation for fire safety and/or zoning violations, and not less than $1.00 nor exceeding $500.00 per violation for other violations; provided, however, that no penalty shall be greater or less than the penalty provided for the same or similar offense under the laws of the state. Each day that a violation continues or each occurrence shall constitute a separate offense.
