On January 29, 2013 at the Gon

zales County Court House in the District Court Room Gonzales, TX beginning at 5:30 p.m., a quorum of the board of directors of the Gonzales County Underground Water Conservation District, will conduct a public hearing and public meeting relating to the applications, summarized as follows, filed by Texas Water Alliance Limited:

Texas Water Alliance Limited (TWA), 3267 Bee Caves Road, Suite 107-509, Austin, Texas 78746 has submitted applications to the Gonzales County Underground Water Conservation District (GCUWCD) to drill and produce thirteen (13) new water wells. The thirteen (13) TWA wells will be located approximately four and one half (4.5) miles west of Waelder, Texas and eight (8) miles northeast of Harwood, Texas. The proposed use of the wells is for public water supply. TWA proposes to produce approximately 15,000 acre feet of water per year at an average rate of approximately 715 gallons per minute per well.

TWA has also applied to GCUWCD for a transportation permit to transfer water from the thirteen (13) production wells to a transportation facility located adjacent to State Hwy 304 between I-10 and US 90 in Gonzales County. The transportation facility is capable of handling the 15,000 acre feet of water per year requested by TWA and will transport the water to the Canyon Lake Water Service Company in addition to other communities and water utilities. The GCUWCD will consolidate its consideration of the thirteen (13) drilling and production applications with the application for a transportation permit. As part of the applications, TWA has agreed to enter into agreements with the GCUWCD relating to mitigation, monitoring, and negotiated export fees. In response to requests by landowners, TWA has requested the GCUWCD’s board of directors to grant a variance to its spacing rules pursuant to section 18(b), so that the properties belonging to Ted Boriack and Robert Mayfield are not included within the spacing shadow of TWA’s proposed well nos. 6 and 7.

During the meeting and hearing, the board of directors will receive evidence submitted by TWA in support of the applications and requests and will discuss and take action regarding the approval or denial of the applications and related requests by TWA. Since all protests of the applications by persons previously granted party status have been withdrawn and the hearing is not a contested case hearing, the board of directors will not receive or consider evidence from persons other than the applicant and the staff of the GCUWCD.

The agenda for the public hearing and meeting is as follows:

2. Announcements regarding hearing procedure.

3. Presiding Officer to take evidence on the applications and requests.

4. Board consideration of and action on applications and requests.

5. Board consideration of and action on Mitigation Agreement.

6. Board consideration of and action on Monitoring Plan.

7. Board consideration of and action on a Negotiated Export Fees Agreement. 8. Adjourn.

Copies of the applications, agreements, and associated maps of the area are available at the offices of the Gonzales County Underground Water Conservation District, 920 Saint Joseph, Room 129, Gonzales, TX from 8:00 am to 5:00 pm, Monday through Friday. The above agenda schedule represents an estimate of the order for the indicated items and is subject to change at any time. These public meetings are available to all persons regardless of disability. At any time during the meeting and in compliance with the Texas Open Meetings Act, Chapter 551, Government Code, Vernon’s Texas Codes, Annotated, the Gonzales County Underground Water Conservation District Board may meet in executive session on any of the above agenda items or other lawful items for consultation concerning attorney-client matters (§ 551.071); deliberation regarding real property (§ 551.072); deliberation regarding prospective gift (§ 551.073); personnel matters (§ 551.074); and deliberation regarding security devices (§ 551.076). Any subject discussed in executive session may be subject to action during an open meeting.

The City of Lockhart is receiving sealed bids at 308 W. San Antonio Street, Lockhart, Texas 78644, until 10 am Wednesday, January 30, 2013, from qualified individuals and/or companies for installation of an elevator that will serve three floors in Clark Library Annex. A bid bond or cashiers check equal to 5% of the total bid must be submitted with the bid. Bids submitted must be good for 90 days. Sealed bid envelopes should be marked “Library Elevator”. Proof of general liability and workers compensation coverage naming the City of Lockhart as an additional insured will be required before final award.

San Antonio Street, Lockhart, Texas 78644, until 10 am on January 31, 2013, from qualified individuals and/or companies for window reconstruction of all 3 floors of the Masonic Building as associated with the Eugene Clark Library Annex. A bid bond or cashier’s check equal to 5% of the total bid must be submitted with the bid. Bids submitted must be good for 90 days. Sealed bid envelopes should be marked “Library Windows”. Proof of general liability and workers compensation coverage naming the City of Lockhart as an additional insured will be required before final award.

 

There are 69 windows varying in size and condition. Bids should reflect only the expected labor costs of the completed job. A completed window job should include removal of the window unit including window frame and associated trim, install temporary covering of the window openings with plywood, removing the window panes, replacing the glass, and assuring each window is returned to fully operable condition, all original paint stripped, primed, and ready for final paint coat. In addition, all windows must be rebuilt to reflect the historical specs provided and must be approved by the Construction Manger at Risk. All building, glass sealant, glass, and approved window molding material will be provided as well as a man lift and scaffolding.
