Early Notice and Public Review of a Proposed Activity in a Floodplain and Wetland
To: All interested Agencies, Groups and Individuals
This is to give notice that Caldwell County (County) has determined that the following proposed action under the Community Development Block Grant Disaster Recovery Program is located in a floodplain and wetland, and that the County will be identifying and evaluating practicable alternatives to locating the action in the floodplain and wetland and the potential impacts on the floodplain and wetland from the proposed action, as required by Executive Order 11988 and 11990, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and Protection of Wetlands.
The proposed drainage facility improvements in the San Marcos River and Plum Creek watershed areas will provide a much-needed increase in the capacity for managing flood waters, reducing risks to humans and damage to infrastructure during future disaster events. The County will demolish the storm-damaged roadway and infrastructure and replace, as follows: Site 1: Black Ankle Road @ Dry Branch Creek, 29.860763, -97.741156: Install 3 15” reinforced concrete pipe with headwalls, roadway construction, to include administration and engineering costs. Site 2: Biggs Road @ West Fork Plum Creek, 29.699823, -97.611511: Install 3 36” reinforced concrete pipe with headwalls, roadway construction, to include administration and engineering costs. Site 3: Political Road @ Dickerson Creek, 29.768455,
-97.784756: Install 2 6’ box culverts with headwalls, roadway construction, to include administration and engineering costs. Site 4: Witter Road @ Jerry Creek, 29.902942,
-97.622807: Install 3 60” reinforced concrete pipe with headwalls, roadway construction, to include administration and engineering costs. All locations are in Caldwell County, TX. Approximately 1.23 acres of floodplains and approximately .40 acres of wetlands will be impacted from the project activities. There are no alternatives.
There are three primary purposes for this notice. First, people who may be affected by activities in floodplains and wetlands, and those who have an interest in the protection of the natural environment, should be given an opportunity to express their concerns and provide information about these areas. Commenters are encouraged to offer alternative sites outside of the floodplain and wetland, alternative methods to serve the same project purpose, and methods to minimize and mitigate impacts. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplains and wetlands can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains and wetlands, it must inform those who may be put at greater or continued risk.
Written comments must be received by Caldwell County at the following address on or before 4/17/20, Caldwell County, 110 S. Main St., Rm. 201, Lockhart, TX 78644, Attn: County Judge’s Office. A full description of the project will be made available to the public for review either electronically or by U.S. mail. NOTICE OF APPLICATION TO OBTAIN A CERTIFICATE OF CONVENIENCE AND NECESSITY 4“O PROVIDE SEWER UTILITY SERVICE IN HAYS AND CALDWELL COUNTIES, TEXAS
County Line SUD has filed an application with the Public Utility Commission of Texas to obtain a Certificate of Convenience and Necessity (CCN) for the provision of retail sewer utility service in Hays and Caldwell Counties.
The requested area is located approximately 5 miles east of downtown Kyle, TX, and is generally bounded on the north by Goforth Rd and Heidenreich Ln; on the east by Rhode Rd and FM 2001; on the south by Misty Ln and Jolly Rd; and on the west by FM 1966. The requested area includes approximately 17,942 total acres and 2 current customers.

Persons who wish to intervene in the proceeding or comment upon action sought should contact the Public Utility Commission, P.O. Box 13326, Austfn, Texas 78711-3326, or call the Public Utility Commission at (512) 93d-7120 or (888) 782-8477. Hearing- and speech-impaired individuals with text telephones (TTY) may contact the commission at (512) 936-7J 36. The deadline for intervention in the proceeding is (30 days from the mailing or publication of notice, whichever occurs later, unless otherwise provided by the presiding officer). You must send a letter requesting intervention to the commission which is received by that date.
If a valid public hearing is requested, the Commission will forward the application to the State Office of Administrative Hearings (SOAH) for a hearing. If no settlement is reached and an evidentiary hearing is held, SOAH will submit a recommendation to the Commission for a final decision. An evidentiary hearing is a legal proceeding similar to a civil trial in state district court.
A landowner with a tract of land at least 25 acres or more, that is partially or wholly located within the requested area, may file a written request with the Commission to be excluded from the requested area (“opt out”) within (30) days from the date that notice was provided by the Utility. All opt out requests must include a large scale map and a metes and bounds description of the landowner’s tract of land.
