PUBLIC NOTICE

ORDINANCE NO. 2011-08-02

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MARTINDALE, TEXAS, REVISING POLICIES FOR DELINQUENT ACCOUNTS FOR SOLID WASTE SERVICES AND WASTEWATER SERVICES; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES.

RECITALS:

1. The City provides wastewater and

solid waste disposal service to the residents of the City, and it is necessary to collect reasonable rates for these services in a prompt manner to enable the City to continue providing the benefits of these services.

2. The City Council has determined that some customers have taken advantage of the City’s leniency in collecting overdue accounts, and that it is not fair to those customers who pay on time, nor is it good management practice, to permit accounts to remain unpaid while still providing services.

3. The City Council wishes to revise City policies related to delinquent utility accounts in order to discourage delinquencies and promote timely payment of City utility bills.

4. The City Council has determined that the policies set out in this ordinance are fair and reasonable, and are likely to contribute to increased collection rates for solid waste and wastewater services.

SECTION 4. (a) A person who violates any provision of this ordinance related to public health and sanitation shall be punished, upon conviction, by a fine not to exceed $2,000.00

(b) A person who violates any other provision of this ordinance shall be punished, upon conviction, by a fine not to exceed $500.00.

(c) Notwithstanding subsection (a) or (b) of this section, no penalty for the violation shall be greater or less than the penalty provided for the same or similar offense under the laws of the state.

(d) Except as otherwise provided in this ordinance, a separate offense shall be deemed committed upon each day on or during which a violation occurs or continues.

(e) Prosecution for violation of a provision of this ordinance is not a prerequisite or bar to any other remedy or relief for the violation under state law or this ordinance.

SECTION 5. This Ordinance will take effect after its passage on the date notice of its adoption is published in a newspaper of general circulation in the City.

AN ORDINANCE OF THE CITY OF LOCKHART, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LOCKHART, TEXAS, TO RECLASSIFY THE PROPERTY KNOWN AS PART OF LOT 2, NIX ADDITION, CONSISTING OF 0.384 ACRE LOCATED AT 321 BOIS D’ARC STREET, FROM PI PUBLIC AND INSTITUTIONAL DISTRICT TO RMD RESIDENTIAL MEDIUM DENSITY DISTRICT.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LOCKHART, TEXAS ADOPTING THE BUDGET AND APPROPRIATING RESOURCES FOR THE FISCAL YEAR 2011-2012, BEGINNING OCTOBER 1, 2011 FOR THE CITY OF LOCKHART, CALDWELL COUNTY, TEXAS.

ORDINANCE 2011-19

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LOCKHART, TEXAS LEVYING MAINTENANCE AND OPERATIONS PROPERTY TAXES FOR THE USE AND SUPPORT OF THE CITY OF LOCKHART, TEXAS AND INTEREST AND SINKING PROPERTY TAXES FOR THE DEBT SERVICE OBLIGATIONS OF THE CITY OF LOCKHART BEGINNING OCTOBER 1, 2011 AND ENDING SEPTEMBER 30, 2012, AND APPROPRIATING EACH PART THEREOF FOR THE SPECIFIC PURPOSES, PROVIDING FOR SEVERABILITY, PROVIDING FOR REPEALER; AND ESTABLISHING AN EFFECTIVE DATE.

REQUEST FOR PROPOSAL

The City of Lockhart is accepting sealed proposals for Medical, Dental and Life Insurance Coverage.  Particulars may be obtained at City Hall, 308 W. San Antonio, P.O. Box 239, Lockhart, Texas 78644.

Sealed proposals marked, “PROPOSAL FOR MEDICAL, DENTAL & LIFE INSURANCE”, will be accepted until 3:00 p.m. on October 27, 2011 at City Hall and will be opened without discussion.  Proposals received after 3:00 p.m. on October 27, 2011 will be returned unopened.

The City of Lockhart reserves the right to accept or reject any or all proposals, or to accept the proposal deemed most advantageous to the City of Lockhart.

ADVERTISEMENT FOR BIDS

Sealed proposals addressed to the Mayor and City Council of the City of Lockhart will be received at the Lockhart City Hall, 308 West San Antonio, Lockhart, Texas 78644, until 11:00 A.M., October 6,  2011 for the Highway 142 12” Water Main Project, at which time and place will be publicly opened and read aloud.  Any bid received after closing time will be returned unopened.

The project consists of installing approximately 4,500 L.F. of 14”, 12” and 8” Water Main and all necessary appurtenances.

Bidders shall submit with their bids a Cashier”s Check in the amount of five percent (5%) of the maximum total bid, payable to the City of Lockhart, Texas without recourse, or a Proposal Bond in the same amount from an approved Surety Company as a guarantee that Bidder will enter into a contract and execute performance and payment bonds on the forms provided, within ten (10) days after the award of Contract.  Bids without check or Proposal Bond will not be considered.

The successful Bidder must furnish Performance and Payments Bonds each in the amount of 100% of the contract price from an approved Surety Company holding a permit from the State of Texas to act as Surety and acceptable according to the latest list of companies holding certificates of authority from the Secretary of Treasury of the United States, or other Surety or Sureties acceptable to the Owner.

The City Council of the City of Lockhart reserves the right to reject any or all bids and to waive formalities.  No bid may be withdrawn within sixty (60) days after the date on which bids are received.
