NOTICE OF APPLICATION FOR FLUID INJECTION WELL PERMIT

E & W Oil, Inc. P. O. Box 1106 Lockhart, TX 78644 is applying to The Railroad Commission of Texas for a permit to dispose of oil and gas waste by injection into a formation not productive of oil or gas.

The applicant proposes to inject fluid into the Edwards formation, Bunch, Joe lease, well number 10W. The well is located 6 miles Southeast of Lockhart in the Luling – Branyon field in Caldwell County.  Fluid will be injected into strata in the subsurface depth interval from 2,600 to 3,300 feet.

LEGAL AUTHORITY: Chapter 27 of the Texas Water Code, as amended, Title 3 of the Texas Natural Resources Code, as amended and the Statewide Rules of the Oil and Gas Division of the Railroad Commission of Texas.

This Notice shall satisfy the above-cited two separate but related procedural notification requirements.

Project Summary

The Texas Community Development Fund project will consist of making water distribution improvements that will benefit 1049 people in western Caldwell County.  The beneficiaries obtain their water from Tri-Community Water Supply Corporation (WSC), a nonprofit water supplier.  Tri Community Water Supply Corporation service area covers approximately 38 square miles in Western Caldwell County along US 80.  Tri-Community WSC CCN area covers the following communities Fentress, Prairie Lea, and Stairtown.  Tri-Community WSC was ordered by the Texas Commission on Environmental Quality (TCEQ) to treat its water supply according to surface water treatment standards for waterborne pathogens.  The presence of water borne pathogens in the water supply is a potential threat to human health.  To comply with TCEQ enforcement orders, the WSC proposes to install a water filtering system to treat approximately 500 gpm to meet current water supply demands.  The filtering system will be in compliance with TCEQ latest standards and will be located at the existing water treatment plant located at the Corner of Gillis and Ward Street in Fentress, TX.

On or about May 23, 2012  Caldwell County, TX will submit a request to the Texas Department of Agriculture (TDA) for the release of Federal funds under Title 1 of the Housing and Community Development Act of 1974 (P.L. 93-383) for TxCDBG Contract #711090 – Water Distribution Improvements project.

Finding Of No

Significant Impact

Caldwell County, TX has determined that the project will have no significant impact on the human environment.  Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.  Additional project information is contained in the Environmental Review Record (ERR) on file at the Caldwell County, TX, Office of the County Judge, 110 South Main St. 2nd Floor, Lockhart, TX 78644 and may be examined or copied weekdays from 8:00 AM to 5:00 PM.

Public Comments

Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the Caldwell County, TX, Office of the County Judge.  All comments received by May 18, 2012 will be considered by Caldwell County prior to authorizing submission of a request for release of funds.  Commentators should specify which part of this Notice they are addressing.

Caldwell County, TX certifies to the Texas Department of Agriculture (TDA) that Tom Bonn in his capacity as County Judge consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  The Texas Department of Agriculture (TDA) approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows Caldwell County, TX to use Program Funds.

The Texas Department of Agriculture (TDA) will consider objections to its release of funds and the Caldwell County, TX certification received by June 7, 2012 or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer or other officer of the County approved by the Texas Department of Agriculture (TDA); (b)  Caldwell County, TX has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the Texas Department of Agriculture (TDA), or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to the Texas Department of Agriculture (TDA) at P. O.
