The Caldwell County Commissioners Court last week amended and restated its Order prohibiting the discharge of firearm in subdivisions.
The order states that discharging firearms is prohibited on lots that are 10 acres or smaller where subdivisions are located even in the unincorporated area of the county.
The order was originally adopted in 2018. Caldwell County has now restated the original order and revised it to include the minimum acreage requirement.
There are seven sections to the order, number two of which includes lots of 10 acres or smaller in subdivisions in Caldwell County.
Section 3 states that an offense under the order is a Class C Misdemeanor.
Section 4 includes defenses to prosecution, one of which is a peace officer on duty, acting in his official capacity, a person is acting in self-defense, or a person defending his or her property as defined in chapter 9 of the Texas Penal Code.
