NOTICE OF PERMIT

APPLICATION  TO

REWORK AN ABANDONED OIL & GAS WELL

3 E Land LLC, PO Box 5, Gonzales, Texas has submitted an application for a permit to the Gonzales County Underground Water Conservation District (GCUWCD) to rework a plugged and abandoned oil and

gas well.  The proposed well is located approximately 3.5 miles northwest of the City of Gonzales on property adjoining County Road 238.  The proposed use of the well is for irrigation.  Mr. Ehrig proposes to produce approximately 566 acre feet of water per year at an average rate of approximately 350 gallons per minute on approximately 566 acres of contiguous land.  3 E Land LLC is also requesting an exception to District Rule 9.A – Classification, Spacing and Production Provisions.

The GCUWCD Rules in effect at the time of this permit application submittal are the April 18, 2008 Rules.  Permit notice and hearing procedures are included in Rule 18.  Contested case procedures are in Rule 19.  Copies of the GCUWCD’s April 18, 2008 rules are available at the GCUWCD’s headquarters at 920 Saint Joseph, Room 129, PO Box 1919, Gonzales, Texas 78629. Interested persons may provide written comments to the GCUWCD on the proposed irrigation well permit application.  Interested persons may also request a contested case hearing on the application submitted by Mr. Ehrig.  A request for a contested case hearing must include a showing of a personal justiciable interest by the requestor.  Written comments and requests for a contested case hearing should be filed within thirty (30) days of the date of publication of this notice and in accordance with Rule 18 of the rules of the GCUWCD.  Comments and requests for a contested case hearing should be submitted to the GCUWCD’s General Manager at 920 Saint Joseph, Room 129, P.O. Box 1919, Gonzales, Texas 78629.

Where no requests for a contested case hearing or comments are received by the District and the General Manager determines the application meets all relevant District rules, a public hearing is not required and the Board may act on the permit application at a Board meeting.

Application has been made with the Texas Alcoholic Beverage Commission for a Distiller’s and Rectifier’s Permit by Hideous, L.C. dba Hideous, L.C., to be located at 5276 Barth Road, Lytton Springs, Caldwell County, TX.  Officer of said corporation is Michael E. Klein, Manager.

Plum Creek Conservation District is accepting bids for ground application of fertilizer and herbicide to approximately 438 acres on 23 flood control structures. Approximately 210 acres to be applied around the 1st of April and 228 acres to be applied around the 1st of May.
